This Privacy Statement governs your use of the software application QB Builder Link® (referred herein as “QBBL” or “Application”) for mobile and other devices that was created by Quality Built, LLC, a Delaware limited liability company (the “Company”, “we”, “us”, “our”). This Privacy Statement does not apply to any other applications, websites, services or products offered by the Company, each of which may have its own privacy statements that differ materially from this Privacy Statement.
The Application is a secure, client-friendly, construction reporting program that efficiently captures construction data and QA (Quality Assurance) processes during the course of new construction. The Application is a collaborative risk management tool that allows the Company’s field consultants to work together with construction managers, superintendents and others involved in the construction industry to track and remediate anomalies observed during construction. Data collected using the Application is summarized in reports that are distributed via automated emails, which provide action items and promote process improvement for construction projects. The Application is versatile and allows the Company’s builder clients to use the Application to collect data independently of the Company’s field consultants in support of such builders’ internal QA program.
By downloading and logging into the Application, you acknowledge and fully understand this Privacy Statement and consent to the information collection and use practices described herein and in the materials associated with the Application. If you do not agree to this Privacy Statement, do not download or log into the Application.
Collection of your Personal Information
The Application obtains information that you provide to us when you download and register the Application. Registration with us is mandatory to enable you to log into the Application and use the basic features of the Application. Builders and/or owners of construction projects will also be required to enter into a contract with us to obtain QBBL services and may be required to provide additional information through the contracting process. Once a contract is entered, additional users associated with the construction project may be entitled to download and register the Application.
Upon execution of a contract for services by the builder and/or owner, we will set up the construction project through our CRM (customer relationship management) system, which will interface with the Application enabling the Application to access the construction project’s name, module name and address, if available. Only registered users will be able to access project data via CRM. When users of the Application register with us, they will be required to provide the user’s full name, telephone number, title, Company name, and email address.
To access the Application, users will be asked to log in with a user name, typically the user’s email address, and password. We will assign users an initial password which can later be changed by the user through QBIN. Passwords are encrypted. Users may also be requested to provide questions and secret answers, which we use to help verify your identity and assist in resetting your password.
When users download and register the Application, we collect the following information:
- A User ID assigned by us to identify the person collecting the data;
- Answers to checkpoints (quality metrics) collected through the Application;
- Photos taken at the time the checkpoint is answered. We do not access the photo gallery located on the mobile device, but we do move the photo taken through the Application into an album which is located on the mobile device after the collected photo has been sent to us through the Application;
- The time the answer and photos were collected; and
- Meta data for the photo, which can include the geo-location of the photo.
We do not collect the following information:
- Mobile telephone number;
- Call logs;
- Financial and payment information or social security numbers; or
If you purchase the Application from an app store, we may also have access to information about your purchase. This information is stored by Google Play. Please see their privacy policies for further details.
Use of your Personal Information
We may use the information you provide to us to contact you from time to time to provide you with important information, reports and required notices, and to provide customer support. We may also inform you of other products or services available.
The Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, and information about the way you use the Application.
If errors occur while using the Application, an error log can be sent back to the Company. This error log contains non-personal data, such as device model, operating system version, where in the Application the error happened. This information is intended to assist further improvement of the Application.
We collect and use your personal information to operate and improve the Application and deliver the services you have requested. These uses may include providing you with more effective customer service; making the Application or services easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies.
If set forth in the insurance binder related to the applicable construction project and/or the contract between us and the builder and/or owner, we may share the checkpoint data and photos collected through the Application with the builder’s and/or owner’s insurance providers.
The Application uses GPS technology (or other similar technology) when you take a photo while logged into the Application. We obtain and store the meta data associated with the photo.
We will share your information with third parties in the ways that are described in this Privacy Statement. We may disclose user provided information and automatically collected information:
- as required by law, such as to comply with a subpoena, or similar legal process;
- when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
- with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement;
- if we are involved in a merger, acquisition, or sale of all or a portion of our assets, as set forth below.
We reserve the right to use and disclose the collected non-personal data in an anonymized and obfuscated way for purposes of advertisement by us or our partners. We do not pass any personally identifiable information to ad networks or advertisers.
We may work with analytics companies, including Spotlink, to help us understand how the Application is being used, such as the frequency and duration of usage.
Data Retention Policy, Managing Your Information
We will retain data and photos collected through the Application, including registration, for an indefinite period of time. Data collected in error, e.g. data collected in an incorrectly identified unit, may be deleted. Please note that some or all of the data provided by users may be required in order for the Application to function properly. We are committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission or electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
If a password is used to help protect your accounts and personal information, it is your responsibility to keep your password confidential. Do not share this information with anyone. We also do not share your log-in credentials or password.
This website does not provide services or products to children under the age of 18.
Merger, Sale or Bankruptcy
By downloading the Application, you consent to the terms of this Privacy Statement and to our processing of data and personal information as set forth herein. “Processing,” means using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information in ways needed to ensure the proper functionality of the Application and as described in this Privacy Statement. If you do not agree to this Privacy Statement, please do not download or use the Application.
Changes to this Statement
This Privacy Statement is effective August 1, 2017. We will occasionally update this Privacy Statement to reflect changes in our services and customer feedback. We encourage you to periodically review this Statement to be informed of how we are protecting your information. It is your responsibility to review this Privacy Statement from time to time to ensure that you continue to agree with its terms.
